Mississippi caps non-economic damages at $1,000,000 in most wrongful death cases; for deaths caused by medical malpractice, the cap is $500,000 under Miss. Code § 11-1-60. Economic damages aren’t subject to these caps.
Punitive Damages
When the defendant’s conduct involved actual malice, gross negligence evidencing a willful, wanton, or reckless disregard for the safety of others, or actual fraud, punitive damages may be awarded. Their purpose is to punish the wrongdoer and deter similar conduct. They are subject to caps under Miss. Code § 11-1-65.
