What Is a Bard PowerPort?
A PowerPort is an implantable port-a-cath device used to deliver medications, fluids, and chemotherapy directly into a patient's bloodstream. Manufactured by C.R. Bard, Inc. (now a subsidiary of Becton, Dickinson and Company), the Bard PowerPort is surgically implanted under the skin, typically in the chest, and connected to a catheter that leads to a large vein near the heart. These devices are commonly prescribed for cancer patients and individuals requiring frequent intravenous treatments.
Because PowerPort devices are meant to remain in the body for extended periods, they must be built to withstand the physical demands of daily use without fracturing, migrating, or failing. According to a growing body of litigation, many Bard PowerPort devices have not met that standard.
Concerns About the Bard PowerPort Design
At the center of the Bard PowerPort litigation are allegations that the device contains a design defect that makes it prone to fracturing. Specifically, lawsuits allege that the catheter tubing is made from polyurethane that can degrade over time when exposed to certain chemicals and body conditions, potentially making it more susceptible to cracking or breaking inside the body.
Plaintiffs in these cases further allege that C.R. Bard was aware of the risks associated with the device and failed to adequately warn patients and healthcare providers. In product liability law, a manufacturer has a duty to warn when it knows or should know that a product poses a danger under foreseeable conditions of use. When that duty is not met, injured patients may have a right to pursue legal action.
Reported Bard PowerPort Complications
Patients who received a Bard PowerPort have reported a range of serious and life-threatening complications. These injuries are the basis of ongoing litigation against the device's manufacturers. Reported complications include:
- Catheter fracture or breakage
- Catheter migration (the catheter moves from its original position)
- Catheter embolization (a fragment travels to the heart, lungs, or other organs)
- Deep vein thrombosis (DVT) or blood clots
- Pulmonary embolism
- Infection and sepsis
- Cardiac arrhythmia or perforation
- Nerve damage
- Device failure requiring surgical removal
Many of these complications require emergency medical intervention, additional surgeries, or result in permanent harm. For patients already managing serious illnesses, a device failure can be devastating.
Growing Litigation & What It Means for You
More than 2,800 people who had a Bard PowerPort chemo port implanted have filed lawsuits in federal courts across the United States. In 2023, these cases were consolidated into a multidistrict litigation (MDL 3081) in the U.S. District Court for the District of Arizona to allow for coordinated pretrial proceedings. MDL consolidation is a common mechanism used in mass tort cases to manage large volumes of similar claims more efficiently.
The first bellwether trial is now set to begin on April 2026, with five additional trials scheduled through February 2027. These early test cases are intended to help both sides assess the strength of claims and estimate potential settlement values, and the first trial could help set the direction for thousands of remaining cases.
Bard has not announced any settlements for fracture-related Bard PowerPort lawsuits, which is normal at this stage. Settlement negotiations in large MDLs typically begin after bellwether verdicts give both sides a clearer picture of case value. If you have a potential claim, now is the time to have your case evaluated.

- Pain and suffering

- Punitive damages, where appropriate
